Your attorney is the best to answer this. In the demand that your attorney sent, they will set forth categories of damages like medial bills - pain and suffering - scarring - lost time from work - permanent impairment. Each one of th3ese categories will have an amount associated with it.

Ask them why they have limited liability? in Colorado you can request a copy of the insurance policy and limits. Be sure to put your own under insured coverage on notice. In Colorado you automatically have under insured coverage. Also use your health insurance to pay for medical bills and your the medical payments on your car insurance to pay for your deductibles. In my practice about 10% of the time. Remember, even though the policy limit on the person who hurt you may be minimal, you still have Under Insured coverage on your car. The most important insurance to have on your car is UM/UIM. You can't control who runs into you, you can control how much insurance you have.

Great question. Usually the Collateral Source Doctrine is not used in Worker's Comp since the medial bills are being paid by worker's comp insurance directly. Also Collateral Source is adopted by some states and not others. It is used in Colorado

That is likely going to be based upon your particular State's laws. Property Ownership Though marriage once gave the husband an estate and interest in his wife's property, this is no longer true in Kentucky. A husband gets no interest (except curtesy right) in any property his wife owned at the time or acquired after marriage during his life. Further, during the marriage relationship, the wife has separate and exclusive use of her property. This property is completely free from the debts, liabilities or control of her husband. The husband does, however, have what is called a "curtesy right" in his wife's property as does the wife have a "dower right" in her husband's property. A married woman, like a man, can hold property, sue and be sued, make property transactions, and collect and receive rents in her own name. Real property owned by a married woman or man can be conveyed or mortgaged free from any claims by the spouse by a court of equity and judgment when he or she has been adjudged mentally incompetent. The husband is not ordinarily liable for his wife's debts contracted or incurred before or after marriage. However, he is liable for such debts to the amount or value of the property he received from her by virtue of the marriage. Also, the husband is primarily liable for necessities furnished to his wife during marriage. Examples of "necessities" include medical and funeral expenses. It seems logical that necessities should include a suitable home in which to live. However, the determination of what are deemed necessities depends upon the economic and social status of the parties. When necessities are purchased on credit extended to the husband personally, the wife has no liability. The wife is secondarily liable if credit is extended for necessities to the wife personally, and the husband failed to pay for them. Ironically, Kentucky law places no general obligation on the wife to support her husband. Common law does impose on a wife, however, the duty to render domestic services in return for support. Marriage In order for a couple to solemnize a marriage, they must first have had a medical examination within 15 days prior to applying for a marriage license from the county court clerk's office. After obtaining a marriage license there is a three-day waiting period before the couple can be married. The license is valid for 30 days after issuance. Marriage may be solemnized generally only by ministers, judges, county officials, religious societies or justices of the peace. At least two persons other than the couple being married and the person marrying them must attend the ceremony. Kentucky law does not recognize the marriage of: 1 ) persons who have been adjudged incompetent, 2 ) persons not legally divorced from a living spouse, 3) persons not married by an authorized person, 4) persons under the age of 18 without consent and 5) persons of blood relations nearer than second cousins. Kentucky law does not recognize common law marriages attempted to be contracted within this state. Kentucky courts do recognize as valid common law marriages contracted in states where such marriages are allowed. David, interesting question on how much of your medical billing and records to order. Did you ask the paralegal why they ordered certain records? Sometimes insurance companies will want 3 year prior medical history to make sure you had not injured the same part of your body as the now claimed injury. Thank you for this question.

I'm only talked about Colorado law, but if you are in a friend's car and are injured, and if you both have underinsured coverage, then you would have two underinsured policies to collect from. Remember, this is in addition to the insurance policies that the at fault car has as well.

I am talking about Colorado law, but no. If the driver of the car and the owner of the car have different insurance policies (they can be with the same insurance company), you can add those two individual policies together

In Colorado, you can add you under insured motorist policy and the person who injured you, their policy. In most states, there isn't going to be double the coverage if there is, for example, a husband and wife on the same policy. You still are limited to what is available on that policy. Phil is right that there may be underinsured/uninsured motorist that you may have on your policy that will cover any amounts in excess of what you get from the person who caused the crash. So, get as much UIM/UM coverage as you can. Where you can potentially "stack" policies (depending on where you live) is if there is umbrella coverage, or the person was driving his/her car in the scope of employment.

Sea, this is a great idea for a show. Thank you for the idea. Generally, the personal injury case will proceed in the state where the collision occurred. I also agree with your attorneys. It is hard to determine how much you will get on a settlement (or verdict if you go to trial), until you are done treating, or at MMI (Maximum Medical Improvement). The reason for this is that if you settle your case before MMI, then you may be under evaluating case. For example, if you settle thinking in 6 months you will be fine, but later you find out you need surgery, then you will not be paid for that surgery.

Policy limits are what are important. Coverage limits sound more like limits as to what incidents are covered by the policy. For example, most insurance does not cover intentional acts.

Excellent question. Many times arbitration is not neutral, so it is good to agree to go with a company that has retired judges that act as arbitrators. Many times what happens in an arbitration/mediation company randomly chooses three arbiters, then you strike one arbiter, the other side strikes one arbiter, leaving you with the sole arbiter. Another way is to have three arbitrators to decide your case. You choose one arbiter, the other side chooses one arbiter and then the two arbiters choose the third.

Phil Harding Thank you! WOW that's pretty extensive, yet those do seem like the only ways of keeping neutrality. If I'm to follow what I read Arbitration's selling point is being a shorter process than regular court but that all sounds rather tedious. The average person isn't familiar with the process (I certainly didn't learn about it in Highschool or College) so it only serves well for those *thoroughly PREPARED*. I'm learning what I can about it now for employment purposes 😊. As of 2014 arbitration agreements are mandatory in my state. We only have 48 days to explicitly declare that we have declined the agreement otherwise we "agree" by default upon hire. Before I agreed or even disagreed I wanted to know all the pros and cons.
